Extract from the
Licence Agreement
USE OF THE English Poetry -
DATA
4.1 LICENSEE and its Users may, subject to the limitations on
THIRD PARTY MATERIAL set out in clause 5.1:
- a) display data from the English Poetry;
- b) print out extracts from the English Poetry for:
- i) private study and research, or
- ii) inclusion in internally circulated essays and papers,
- or iii) inclusion in materials for class/course
work;
- c)make xerographic copies of the above printouts for class/course work;
- d) download small extracts of the English Poetry
only, to merge with other text and/or graphics for
documents relating to private study and internally
circulated essays and papers;
- e)copy portions of the English Poetry onto a
temporary, non-commercial electronic database for
temporary use or storage during research;
- f)include portions of the English Poetry and
concordances of single words and phrases:
- i) in any article in a printed journal, or
- ii) in a single essay or contribution which forms part of a
printed collection, or
- iii) in any printed monograph or critical edition.
If such portions of the English Poetry comprise more than
forty percent (40%) of any article in a printed journal, or of
any single essay or contribution which forms part of a
printed collection, or of any printed monograph or critical
edition, the User must obtain permission in writing from CH
which shall not be unreasonably withheld.
4.2LICENSEE and its Users shall not:
- a)manipulate and use the data to create publications or
services in print or in electronic form which in any
way compete with or interfere with publications and
services already provided by or publicly announced
to be provided in the future by CH;
- b)use all or any part of the English Poetry for, or as
part of the operation of, a service bureau or other
business based on the redirection or resale of the
licensed software, database or system components;
- c)transmit on a network or make any portion of the
English Poetry available in machine-readable form
in any format to any person, group or organisation
that is not itself a User, including for non-commercial
uses, except for electronic delivery to a publisher or
printer for publication in printed form as specified
above in Clause 4.1.f, provided, however, that such
distributed data must be returned to the User when
no longer required for production of the publication
and that the User must provide for such return in any
agreement to publish such data;
- d)reproduce on CD-ROM or convert complete or
substantial portions of the English Poetry into/onto
any other medium;
- e)rent, lease, barter, assign, lend, sell, transfer, convey
or give all or any part of the English Poetry to any
person, firm, company or institution;
- f)attempt to reverse engineer, decompile or
disassemble all or any part of any software program
incorporated or used in the English Poetry;
- g)download for use with any application other than the
English Poetry the specially extended Latin fonts
Times New Roman 1 C-H and Times New Roman 2
C-H.
THIRD PARTY
RIGHTS
5.1 - a) Parts of the English Poetry are copyright material
of third parties from whom CH has obtained an
appropriate licence for inclusion of such parts in the
English Poetry. Such parts in which third party
intellectual property rights exist are clearly identified
if selected for downloading or printing and are
hereinafter referred to as "THIRD PARTY
MATERIAL".
- b)Before any publication or inclusion of THIRD PARTY
MATERIAL in any essays, internally circulated
papers, or materials for class/course work the
LICENSEE must obtain the prior consent in writing
from the relevant Third Party and CH. Such consent
shall not be unreasonably withheld. Both the Third
Party and CH reserve the right to require a
reasonable reproduction fee.
- c)It is hereby confirmed that "Fair Dealing" (as defined
in Sections 29 and 30 of the Copyright Designs and
Patents Act 1988) of any copyright material
contained in the English Poetry shall not constitute
infringement of the copyright of CH or any Third
Party and is permitted hereunder.
7.1Without prejudice to the other provisions of this Agreement
relating to any extract or text, all extracts from the Bible in
English which are included in any publications, essays,
internally circulated papers, or materials for class/course
work must contain the following copyright statement:
"Reproduced from the English Poetry Full Text Database, Copyright (c)
